The website at clevertaxeselite.com (the "Site") is owned and operated by Clever Taxes Elite ("we", "us" or "our"), 361 River Rd, Edgewater, NJ 07020.

These Terms of Use ("Terms") govern your use of the Site. By using the Site, you agree to them. If you do not agree, please do not use the Site. The Site is intended for adults; you must be at least 18 to use it.

These Terms cover the website only. They are not an engagement letter and they do not describe the terms of any professional service. If you become a client, your engagement letter governs that work.

1. Nothing here is tax advice

This is the important one, so it goes first.

Everything on the Site, including the pages, the videos linked from it and any figure or example, is general information. It is not tax, legal, accounting, or financial advice, and it is not a recommendation to do anything in particular with your own affairs.

Tax outcomes depend on facts. Yours are not the facts in any example shown here. Do not act on anything from the Site without advice on your own situation, from us or from somebody else.

2. Using the Site does not make you a client

Reading these pages does not create a professional relationship. Neither does sending the contact form, and neither does receiving a reply to it.

A relationship begins when both sides sign an engagement letter setting out what is being done, by whom, and for what fee. Until that exists, nobody is your accountant and no work is being done on your behalf.

3. Do not send sensitive information through the Site

The contact form asks for a name, an email address, an optional phone number, and a short description. That is all it is for.

Do not send a Social Security number, figures from a return, bank details, or documents through this form. There is no field for any of it, and the form is not a secure channel for that kind of material. Once you are a client, there is a proper secure channel and we will point you to it.

4. Reviews and examples are not promises

Reviews describe one person's experience. Examples describe made-up facts under the rules in force when they were written. Neither is a prediction, a guarantee, or an average of what you can expect. Tax law changes, and facts differ.

5. Accuracy

We try to keep the Site correct and current. Tax rules move constantly, and a page that was right when written can quietly go stale. Pages that state figures carry the date they were last checked. We do not warrant that everything here is accurate or complete at the moment you read it.

6. What you may do with the Site

We give you a limited, non-exclusive, non-transferable, revocable licence to use the Site for your own personal, non-commercial purposes. You are welcome to read it, share a link to it, and print or save a page for your own use.

You may not:

republish, sell, or commercially exploit the Site or its content, or present any of it as your own;
use the Site in a way that breaks the law, or that interferes with or disrupts the Site or the servers that host it;
try to gain unauthorised access to any part of the Site or the systems behind it;
send anything through the contact form that is unlawful, abusive, or not a genuine enquiry, including spam;
remove any copyright or other notice from material you are permitted to copy.

7. What belongs to whom

The text, design, logo, and video content are owned by Clever Taxes Elite or used with permission. These Terms do not transfer any of that ownership to you. All rights not expressly granted here are reserved.

The name "Clever Taxes Elite" and the logo are ours. Please do not use them in a way that suggests we endorse or are connected with something we are not.

If you send us suggestions about the Site, we may use them freely, without owing you anything for them. Please do not send suggestions you consider confidential.

8. Privacy

Our Privacy Policy explains what the Site collects and what happens to it. It forms part of these Terms. If the two ever conflict on a question of personal information, the Privacy Policy controls.

The Site sets no cookies and uses no tracking technologies. The Privacy Policy explains the one exception you can choose: loading the interactive Google map.

9. Links and other services

The Site links to Instagram, Facebook, LinkedIn and Google Maps, and the contact form is delivered through a form-relay service called Web3Forms. Those are other companies' services, under their own terms and their own privacy policies. We do not control them, do not endorse them, and are not responsible for them. Your use of them is at your own risk.

10. Changes and availability

We may change, suspend, or remove any part of the Site at any time, with or without notice. We do not promise the Site is always reachable. It may be down for maintenance, or because something broke. We are not liable to you if that happens.

11. Disclaimer of warranties

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES ABOUT THE SITE, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL CODE, OR THAT ITS CONTENT IS ACCURATE, COMPLETE, OR CURRENT.

12. Limitation of liability

TO THE EXTENT THE LAW ALLOWS: (A) WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR LOST DATA, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SITE, OR FROM ANYTHING YOU DO OR DO NOT DO ON THE BASIS OF WHAT YOU READ HERE; AND (B) OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THE SITE OR THESE TERMS IS LIMITED TO US $50. HAVING MORE THAN ONE CLAIM DOES NOT RAISE THIS LIMIT.

Nothing in these Terms limits any liability that cannot be limited by law, including liability for fraud or for our own wilful misconduct.

And nothing here touches our professional work. If you are a client, what we owe you is set by your engagement letter and by the rules that govern a licensed CPA. This page cannot and does not reduce that.

13. Your responsibility

If you break these Terms or the law in using the Site, and a third party brings a claim against us because of it, you agree to cover our reasonable costs of that claim, including reasonable attorneys' fees. This does not apply to anything caused by our own fault.

14. Ending access

We may block or end anyone's access to the Site, or to the contact form, if we believe they have broken these Terms, for example by sending spam. Sections 7 and 11 to 18 continue to apply after that.

15. Notices for residents of certain states

New Jersey. Nothing in these Terms limits any right you have under New Jersey law, including under the New Jersey Consumer Fraud Act. If you are a New Jersey resident, sections 11, 12 and 13 apply to you only as far as New Jersey law permits; any part of them that New Jersey law does not permit does not apply to you.

California. Under California Civil Code Section 1789.3, California users are entitled to the following notice. The Site is provided by Clever Taxes Elite, 361 River Rd, Edgewater, NJ 07020, clevertaxes@gmail.com. Use of the Site is free of charge. To make a complaint about the Site or to get more information about it, write to us at that address. You may also contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210.

Privacy rights in other states. The privacy rights that some states give their residents, and how we offer them to everyone, are set out in our Privacy Policy.

16. Governing law and disputes

These Terms, and any dispute about the Site, are governed by the laws of the State of New Jersey, without regard to its conflict-of-law rules. Any such dispute belongs to the state or federal courts sitting in Bergen County, New Jersey, and you and we both consent to those courts.

Two exceptions: either side may bring an individual claim in small claims court if it qualifies, and either side may ask any competent court for an injunction to protect its intellectual property.

17. Electronic communications

When you use the Site or email us, you agree that we may reply electronically, and that our emails satisfy any legal requirement that a communication be in writing.

18. Accessibility

We want the Site to work for everyone, including people with disabilities. We aim to meet the Web Content Accessibility Guidelines (WCAG) 2.1 at Level AA. 19. The rest of the legal machinery

These Terms, together with the Privacy Policy, are the whole agreement between you and us about the Site. If a court finds any part of them unenforceable, that part is limited to the minimum extent necessary and the rest stays in force. If we do not enforce a provision, we have not waived it. You may not transfer your rights under these Terms; we may transfer ours to a successor of the firm. "Including" means "including without limitation".

20. Changes to these Terms

These Terms can change. The date at the top will say when they last did. If you use the Site after a change, the new version applies to that use.
